El derecho penitenciario se ha de adaptar a la realidad social del tiempo en que se encuentre, de otro modo, este derecho no tendr\u00eda sentido alguno, no es un conjunto de normas ancladas en el tiempo, inmutables, obsoletas, sino, que no cabe duda alguna de que las normas se reforman, se derogan, public\u00e1ndose otras nuevas, y que  la raz\u00f3n que subyace a este asunto es la adaptaci\u00f3n del derecho a la sociedad, sociedad que evoluciona con el tiempo y que necesita de un cuerpo legal que regule los distintos aspectos de su convivencia en el \u00e1mbito penitenciario. Es por ello, que el legislador no deber\u00eda ignorar estas necesidades; y es a partir de esta afirmaci\u00f3n, donde en marcamos el presente trabajo.   \ttomando como p\u00f3rtico de entrada la evoluci\u00f3n de la normativa penitenciaria a lo largo de la historia, para as\u00ed, poder analizar el actual sistema penitenciario espa\u00f1ol, compar\u00e1ndolo con otros sistemas penitenciarios (el europeo, el anglosaj\u00f3n, el sudamericano, etc.), Nos centramos en la revisi\u00f3n de la pol\u00edtica penitenciaria acorde con la sociedad actual, para poder concretar unas propuestas de futuro.  abstract  \tthe penitentiary norm has been evolving throughout the time because society has been demanding it. Penitentiary right should be adjusted to the social reality of the time to which it refers, otherwise, this right would have no sense, it is not a set of norms ancho red in time, immutable, obsolete, if not, and there is no doubt about it, norms are reformed, derogated, new ones are published, and the reason behind this is the adaptation of the right  to the society, society which evolves during time and which needs a legal body regulating the different aspects of his coexistence in penitentiary circumstances. For this, the legislator should not ignore these needs; and it is starting from this affirmation, where we frame our present work.  \twe take as a starting point the evolution of penitentiary norm throughout history to be able to analyze the actual spanish penitentiary system, comparing it with other penitentiary systems (the european, the anglo-saxon, the south american, etc.) And finishing
