El marco de referencia es la manera particular como un tipo de alumno expresa la peculiaridad de su estructura personal que le conduce a la exclusi\u00f3n y de all\u00ed a la frustraci\u00f3n que se deriva de la imposibilidad de llegar a la meta que la cultura propone como deseable.  La poblaci\u00f3n escogida para el estudio son adolescentes en conflicto con la ley en r\u00e9gimen de custodia  en los centros de atenci\u00f3n integral del pa\u00eds.   El estudio se dirige a establecer la relaci\u00f3n entre la divergencia como una condici\u00f3n personal que se expresa en las propiedades creativas de este grupo como una situaci\u00f3n que al propiciar la exclusi\u00f3n escolar influye en la desviaci\u00f3n de conducta.   El perfil de esta poblaci\u00f3n se analiza en funci\u00f3n de los factores familiares y sociales asociados a esta problem\u00e1tica. Los resultados de la investigaci\u00f3n muestran una relaci\u00f3n significativa entre la divergencia y la exclusi\u00f3n y entre la exclusi\u00f3n y la desviaci\u00f3n de conducta, lo cual establece que mientras mayor es el nivel de pensamiento divergente mayor es la probabilidad de   exclusi\u00f3n educativa y que mientras mayor es el valor de exclusi\u00f3n mayor es la probabilidad de riesgo para desviaci\u00f3n de conducta. Se concluye que la escuela en cuanto es un \u00e1mbito de exclusi\u00f3n es un factor de riesgo para conducta desviada y que, por tanto, es un factor de riesgo para el alumno divergente.    palabras clave: adolescentes en conflicto, conductas divergentes, escuela como \u00e1mbito de riesgo, exclusi\u00f3n, conducta desviada. abstract the purpose of this research is to demonstrate the relationship that exists between the school as an area of risk to the deviation of conduct and the divergent ability of students who find it difficult to conform to the rules of the institution and follow the daily dynamics of schooling. The frame of reference is the particular way a type of student expresses the peculiarity of its personal structure that leads to exclusion and from there to the frustration that stems from the impossibility of reaching the goal that this culture established as desirable. The people chosen for the study are adolescents in conflict with the law in regime of custody in the centers for comprehensive care in this country. The study is aimed to establish the relationship between the divergences as a personal condition that is expressed in creative properties in this group as a situation which in the foster school exclusion affects the deviation of conduct. The profile of this population is analyzed based on family and social factors associated with this problem. The results of this research studies have shown a significant relationship between the divergence and exclusion and between exclusion and the deviation of conduct, which states that the greater is the level of more divergent thinking is the probability of educational exclusion and that while greater is the value of higher exclusion is the probability of risk to conduct deviation. It is concluded that the school when becoming an area of exclusion is a risk factor for deviant behavior and that, therefore, is a risk factor for the divergent student. key words:  adolescents in
