Debido a su especificidad subjetiva, plantea importantes problemas de regulaci\u00f3n por el derecho internacional relativo a los conflictos armados o derecho internacional humanitario. La existencia y  funciones crecientes de este nuevo actor han dejado, en parte, obsoleto este cuerpo normativo. El objetivo consiste en determinar cu\u00e1l deber\u00eda ser el tratamiento de la figura de la empresa militar y de seguridad privada. Se entienden incluidas dentro de este apelativo las empresas privadas que prestan todo tipo de servicios de asistencia, formaci\u00f3n, provisi\u00f3n y consulta sobre temas de seguridad. la metodolog\u00eda usada en la investigaci\u00f3n ha sido b\u00e1sicamente la tradicional y l\u00f3gica dentro del \u00e1mbito investigador legal, esto es, la investigaci\u00f3n bibliogr\u00e1fica, consistente en la b\u00fasqueda, recopilaci\u00f3n, organizaci\u00f3n, valoraci\u00f3n, cr\u00edtica e informaci\u00f3n de datos bibliogr\u00e1ficos. La mayor\u00eda de los datos a obtener no van a ser de car\u00e1cter primario, es decir, obtenidos directamente a partir de la realidad misma sin sufrir ning\u00fan proceso de elaboraci\u00f3n previa. Los datos secundarios, los principales en el presente trabajo de investigaci\u00f3n, son obtenidos por otros y nos llegan elaborados y procesados de acuerdo a los fines de quienes inicialmente los manejaron. Estos datos han sido ya recolectados en otras investigaciones y son conocidos, b\u00e1sicamente, mediante los documentos escritos correspondientes: libros, revistas, monograf\u00edas&#8230;  la figura de la empresa militar y de seguridad privada est\u00e1 de plena actualidad, habi\u00e9ndose generado un apasionado debate al respecto. Las posturas predominantes son radicalmente contrarias a estas empresas, equipar\u00e1ndolas directamente con la figura del mercenario, sin explorar otras v\u00edas que pudieran permitir la regulaci\u00f3n adecuada de una figura cuya participaci\u00f3n, guste o no, es creciente en los conflictos armados actuales. Los esfuerzos legales internacionales se han centrado casi exclusivamente en la eliminaci\u00f3n de los mercenarios, sobre la base de que sus actividades amenazan la autodeterminaci\u00f3n y la descolonizaci\u00f3n. En lo que respecta a su regulaci\u00f3n en el \u00e1mbito nacional, la misma consiste en la simple remisi\u00f3n al derecho internacional humanitario o en la su inexistencia, salvo contadas excepciones.  se trata de un tema necesitado de evidentes cambios para la mejora de su regulaci\u00f3n y, por tanto, predispuesto a la innovaci\u00f3n, sobre el que cabe efectuar propuestas de lege ferenda con las que tratar de dar respuesta a los problemas e insuficiencias que su tratamiento actual plantea. La provisi\u00f3n privada de servicios militares y de seguridad desaf\u00eda las asunciones convencionales sobre las funciones del estado naci\u00f3n como protagonista principal en asuntos militares y como garante de la seguridad f\u00edsica de sus ciudadanos. En ausencia de unas estructuras legales o reguladoras efectivas, dichas actividades plantean cuestiones de legalidad, legitimidad y responsabilidad en la esfera de la pol\u00edtica de seguridad. como conclusiones, una vez comprobadas las deficiencias del cuerpo normativo actual tanto en el plano internacional como nacional, se establecen las l\u00edneas b\u00e1sicas que deber\u00edan guiar una regulaci\u00f3n omnicomprensiva y adaptada a la nueva configuraci\u00f3n del fen\u00f3meno de la prestaci\u00f3n privada de servicios militares y de seguridad.  abstract  &quot;towards a proper regulation of the private military and security corporation&quot;. the thesis focuses on the analysis of the private military and security corporation, a figure which is not a mere evolution of the classic mercenary. Due to its specifity, it arises important issues related to its regulation by the international law of the armed conflicts or international humanitarian law. The existence and increasing functions of this new player of the armed conflicts have left partly obsolete this legal body. The goal is to determine which should be the regulation of the private military and security industry. Within this denomination are included the private enterprises that offer a wide variety of services related to assistance, training, procurement and consulting on military and security subjects. the methodology used for the research has basically been the traditional and logical within the legal research, that is, literature research involving the search, collection, organization, assessment, review and critical evaluation of data. Secondary data, key in this research, have already been obtained by others, elaborated and processed according to the goals of those ones who used them initially. These data have been collected from other researches and they are known, basically, through the relevant written documents: books, journals, monographs\u00c2\u00bf the figure of the private military and security corporation is particularly relevant today, having generated a passionate discussion. The predominant positions are radically against these enterprises identifying them and the mercenaries as the same thing, without exploring other ways that would allow a proper regulation of this figure whose participation in the current armed conflicts is increasing dramatically. The international legal efforts focus almost exclusively on eliminating  mercenaries on the basis that their activities threaten self-determination and decolonization. From the national perspective, the nations address and resolve the issue through its reference to the international humanitarian law, or simply they do not have any regulation at all, with some limited exceptions. this subject needs obvious changes in the approach in order to improve the regulation through proposals of lege ferenda to deal with the problems and shortcomings of its current treatment. The private provision of military and security services defies the conventional assumptions on the functions of the national state as the major player in military affairs and as a guarantor of the physical security of its citizens. Due to the lack of proper legal structures, those activities raise questions of legality, legitimacy and accountability in the field of security policy. at the conclusion, once proven the deficiencies of the current legal body both in the international and national levels, basic guidelines are proposed in order to have an encompassing regulation adapted to the new phenomenom of the private
