{"id":115636,"date":"2018-03-11T10:44:14","date_gmt":"2018-03-11T10:44:14","guid":{"rendered":"https:\/\/www.deberes.net\/tesis\/sin-categoria\/la-proteccion-del-consumidor-en-el-contrato-de-compraventa-de-vivienda-en-construccion\/"},"modified":"2018-03-11T10:44:14","modified_gmt":"2018-03-11T10:44:14","slug":"la-proteccion-del-consumidor-en-el-contrato-de-compraventa-de-vivienda-en-construccion","status":"publish","type":"post","link":"https:\/\/www.deberes.net\/tesis\/derecho-civil\/la-proteccion-del-consumidor-en-el-contrato-de-compraventa-de-vivienda-en-construccion\/","title":{"rendered":"La protecci\u00f3n del consumidor en el contrato de compraventa de vivienda en construcci\u00f3n"},"content":{"rendered":"<h2>Tesis doctoral de <strong> Venancio Parra Torres <\/strong><\/h2>\n<p>Titulo: la protecci\u00f3n del consumidor en el contrato de compraventa de vivienda en construcci\u00f3n.  objetivos: el an\u00e1lisis cr\u00edtico de la protecci\u00f3n ofrecida al consumidor y usuario en la compraventa de vivienda. \t el trabajo estudia  la configuraci\u00f3n legislativa y jurisprudencial de la figura del consumidor y usuario y, dentro del \u00e1mbito del derecho de consumo, se centra en la especial atenci\u00f3n prestada por el legislador al contrato de adquisici\u00f3n de vivienda.  una vez definido el \u00e1mbito de actuaci\u00f3n, se analizan las distintas cuestiones que pueden surgir a lo largo del desarrollo del contrato, sin olvidar las consecuencias del incumplimiento, que es donde este trabajo adquiere una dimensi\u00f3n m\u00e1s din\u00e1mica.  en otro orden, se realiza un an\u00e1lisis de las distintas acciones de protecci\u00f3n de los consumidores, centr\u00e1ndonos en la coordinaci\u00f3n de los mismos.   \tpor \u00faltimo, se examinan los distintos sistemas alternativos a la v\u00eda jurisdiccional para solucionar los posibles conflictos que pudieran surgir entre las partes intervinientes.     metodolog\u00eda: mediante el an\u00e1lisis de la legislaci\u00f3n vigente (comunitaria, estatal y de las comunidades aut\u00f3nomas, centr\u00e1ndonos especialmente las comunidades de murcia y alicante), vista desde una perspectiva hist\u00f3rica y por comparaci\u00f3n con la de otros pa\u00edses de nuestro entorno.  tambi\u00e9n se exponen las diversas corrientes doctrinales que han analizado los principales temas suscitados, as\u00ed como las resoluciones judiciales que han resuelto los problemas pr\u00e1cticos que presenta el objeto del trabajo.   resultados: se alcanzan diecis\u00e9is conclusiones cr\u00edticas, que analizan aspectos concretos, donde el autor expone las conclusiones a las reflexiones efectuadas a lo largo del trabajo.  a este respecto, destaca la idea de que el grado de protecci\u00f3n legislativo es muy elevado, aunque presenta carencias por la dificultad de coordinaci\u00f3n del entramado normativo y la tradicional tendencia de los juzgados a solucionar los problemas derivados de las relaciones de consumo \u00fanicamente en base a la respuesta ofrecida por el c\u00f3digo civil. Igualmente, se requiere la adopci\u00f3n de una postura m\u00e1s activa, por parte de los notarios y registradores, en la defensa de los derechos de los consumidores y usuarios.   \tse destaca la aplicaci\u00f3n del trlgdcu a peque\u00f1os empresarios que act\u00faan al margen de su actividad empresarial o profesional y se analiza la distinta respuesta que el legislador ofrece, seg\u00fan sea de aplicaci\u00f3n el trlgdcu o ldgc.    \ten otro orden, se estudian aspectos concretos de determinadas situaciones, consecuencia de la falta de coordinaci\u00f3n entre catastro y registro.  \tse constata la trascendencia de la fecha de terminaci\u00f3n de la vivienda y de la obligaci\u00f3n de afianzamiento de las cantidades entregadas a cuenta, poniendo de manifiesto la superaci\u00f3n del criterio jurisprudencial tradicional.   \tse analizan diversas cl\u00e1usulas habituales de la contrataci\u00f3n inmobiliaria, tanto en lo que respecta a su compatibilidad con la normativa de consumo, como en las  consecuencias de su  inclusi\u00f3n en el contrato.   \tse defiende  la utilizaci\u00f3n de los sistemas alternativos a la v\u00eda jurisdiccional para la resoluci\u00f3n  de los conflictos  que surjan entre el consumidor-comprador y el vendedor-empresario. Asimismo,  se considera necesario un mayor compromiso por parte de los poderes p\u00fablicos en el fomento de estos sistemas  como instrumentos  id\u00f3neos para la defensa de los intereses de los consumidores.    title:  protection of the consumer in relation to purchase contracts for properties under construction.  objectives: a critical analysis of the protection provided to the consumer during the purchase of property.  \tthis thesis studies the legislative and case-law configuration of the figure of the consumer and the public, within the field of consumer rights, focusing on the special attention afforded by legislators on property acquisition contracts.  \tonce the scope of action has been defined, the various issues that can arise during the development of the contract will be analysed, without forgetting the consequences of breaches of contract, where the study takes on a more dynamic dimension.  \tadditionally, an analysis of the different efforts that are made to protect the consumer will be carried out, concentrating on the coordination of said efforts.  \tand finally, the varied alternative systems to the jurisdictional channels for solving possible conflicts that could potentially arise between the intervening parties will be examined.   methodology: analysis of the current legislation (regional, state, and autonomous community, focusing particularly on the regions of murcia and alicante), viewed from an historical perspective and through comparison with neighbouring countries.  \tfurthermore, the diverse doctrinal tendencies that the principal topics have analysed will be presented, as well as the court rulings that have solved the practical problems that the objective of this thesis presents.   results: 16 conclusions will be reached, which analyse specific aspects, where the author will present the conclusions to the critical reflections make throughout the study.  \tin this regard, the idea that the level of legislative protection is rather high comes to the forefront, although it is somewhat lacking due to the difficulty in coordinating the regulatory framework and due to the traditional tendency of the courts to solve the problems stemming from consumer relations basing themselves entirely on the civil code. Similarly, a more active posture needs to be adopted on the part of the notaries and registrars with regard to the defense of consumer rights.  \tthe application of trlgdcu to small business owners who act on the fringes of their corporate or professional activity is emphasized, and the different responses that the legislator offers are ananlysed, depending on whether trlgdcu or ldgc is applied.  \tmoreover, the specific aspects of certain situations, consequence of the lack of coordination between real estate records and record of deeds, are studied.  \tthe importance of the date of completion of building works is confirmed, as is the obligation to guarantee the installments paid, making evident the overcoming of the traditional precedence criteria.  \tthe varying common clauses in real estate contracts will be analysed with respect to their compatibility with consumer regulations as well as the consequences of their inclusion in the contracts.  \tthe use of alternatives to the judicial channels for the resolution of conflicts arising between the consumer-buyer and the seller-corporation is upheld.
