{"id":117942,"date":"2018-03-11T10:47:44","date_gmt":"2018-03-11T10:47:44","guid":{"rendered":"https:\/\/www.deberes.net\/tesis\/sin-categoria\/el-regimen-de-garanta%c2%adas-en-los-productos-de-consumo\/"},"modified":"2018-03-11T10:47:44","modified_gmt":"2018-03-11T10:47:44","slug":"el-regimen-de-garanta%c2%adas-en-los-productos-de-consumo","status":"publish","type":"post","link":"https:\/\/www.deberes.net\/tesis\/ciencias-juridicas-y-derecho\/el-regimen-de-garanta%c2%adas-en-los-productos-de-consumo\/","title":{"rendered":"El r\u00e9gimen de garant\u00edas en los productos de consumo"},"content":{"rendered":"<h2>Tesis doctoral de <strong> Fernando Lopez Alonso <\/strong><\/h2>\n<p>Resumen   i.\tObjetivos de la tesis. el fin de la tesis ha sido el an\u00e1lisis del r\u00e9gimen de garant\u00edas en los productos de consumo, establecido en el real decreto legislativo 1\/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la ley general para la defensa de los consumidores y usuarios y otras leyes complementarias, el cual recoge el principio del conformidad que obliga al vendedor a entregar al consumidor y usuario un producto que no presente defectos siendo conforme con el contrato.  para realizar tal an\u00e1lisis se comenz\u00f3 por examinar los diferentes remedios tradicionales que se han articulado para afrontar la aparici\u00f3n de defectos en el bien objeto de una compraventa: el saneamiento por vicios ocultos, el r\u00e9gimen general del incumplimiento de las obligaciones rec\u00edprocas (previsto en los art\u00edculos 1101, 1124 y concordantes del cc) y el del error que invalida el consentimiento (recogido en el art\u00edculo 1266 del cc). posteriormente se consideraron los problemas que se pueden suscitar en el  citado r\u00e9gimen de garant\u00edas en los productos de consumo; para ello se examinaron tales problemas analizando la doctrina y jurisprudencia aplicable, desarrollando a su vez una opini\u00f3n propia formada al respecto.  el trabajo realizado ha posibilitado finalizar formulando unas  conclusiones fundadas sobre el objeto de la tesis.   ii.\tMetodolog\u00eda. i)\tlectura y sistematizaci\u00f3n de doctrina. ii)\tlectura y sistematizaci\u00f3n de jurisprudencia. iii)\tsistematizaci\u00f3n de conceptos, redacci\u00f3n y conclusiones.  iii.\tResultados o conclusiones. el estudio desarrollado ha permitido: i)\tconocer el origen y desarrollo de los sistemas tradicionales que se han concebido para remediar el problema consistente en la aparici\u00f3n de defectos en el bien objeto de una compraventa. ii)\tcomprobar que el r\u00e9gimen de garant\u00edas en los productos de consumo representa una materia de sumo inter\u00e9s dado que:  a.\tSe dan opiniones divergentes en la doctrina sobre un mismo aspecto. V\u00e9ase  las discrepancias que se dan entre los autores a la hora de determinar a qu\u00e9 contratos se aplica el citado r\u00e9gimen de garant\u00edas (apartado ii. 3. A. C) otros contratos). b.\tLos tribunales aplican razonadamente dicho sistema de diferente manera ante situaciones aparentemente similares. As\u00ed, existen pronunciamientos divergentes a la hora de analizar la aparici\u00f3n de defectos una vez transcurridos  seis meses desde la entrega del bien adquirido (apartado ii. 8. B. Defectos que se manifiestan a los seis meses de la entrega). c.\tExisten vac\u00edos legales que son necesarios colmar mediante la aplicaci\u00f3n supletoria de otras normativas. Por ejemplo, cuando se den defectos en un producto provocados por el uso que el consumidor dio al bien de consumo atendiendo a las instrucciones facilitadas por el vendedor, se considera que la aplicaci\u00f3n supletoria del c\u00f3digo civil para todas las vicisitudes no previstas por el t\u00edtulo iv del trlgdcu debe provocar que el vendedor haga frente a dichos defectos dada su responsabilidad contractual (art\u00edculos 1101, 1124 y concordantes del cc) con respecto al consumidor comprador (apartado ii. 5. A. D) (ii) incorrecto uso).    summary  i. Objectives of the thesis. the aim of the thesis has been the analysis of the consumer goods sale and associated guarantees established by the royal legislative decree 1\/2007, 16th november 2007, approving the revised text of the general law for the protection of consumers and users and other supplementary laws, which enshrines the principle of conformity that commits the seller to deliver a product to the user without any defect or deterioration and conform to the consumer-user contract. in order to perform such analysis, i started studying the different traditional legal systems employed to solve the appearance of defects in the good sold: the action of latent defects, the general scheme of the breach of reciprocal obligations (under articles 1101, 1124 and related of the civil code) and the error that invalidates consent (under article 1266 of the civil code). subsequently, i considered the problems that can raise in the system of  consumer goods sale; regarding this issue, such problems were examined by analyzing the doctrine and jurisprudence applicable, developing as well an own formed opinion about it. the work developed has allowed me to finalize this dissertation formulating conclusions based on the object of the thesis.  ii. Methodology. i)\treading and systematization of doctrine. ii)\treading and systematization of jurisprudence. iii)\tsystematization of concepts, writing and conclusions.  iii. Results or conclusions. the study carried out has allowed me: i)\tto know the origin and development of the traditional systems that were designed in order to solve the problem regarding the appearance of defects in the good sold. ii)\tto check that the sale of consumer goods and associated guarantees is a matter of great interest due to:  a.\tThe different points of view existing between the doctrine on the same topic. E. G. The discrepancies developed among authors in order to determine which contracts are assured by the referred system of consumer goods and associated guarantees (section ii. 3. A. C) other contracts). b.\tDivergent court decisions (regarding apparently similar situations) in which such system of consumer goods and associated guarantees is reasonably applied. For instance, there are different decisions solving the problem concerning the appearance of defects six months after the delivery of the product (section ii. 8. B. Defects that appear within a six months period following delivery). c.\tThere are loopholes that are needed to be filled by the supplementary application of other rules. For example, when a defect occurs in a product due to the misuse of a consumer who has attended the instructions given by the seller, the supplementary application of the civil code (for all situations not provided by the system of consumer products sales) would make the vendor liable for such defects because of his contractual liability (articles 1101, 1124 and related of the civil code) to the consumer purchaser (section ii. 5. A.
