A cual legitimar?; Como construir cientificamente un poder politico duradero?. He aqui la problematica afrontada por hobbes en su leviatan, obra cumbre de madurez de thomas hobbes.  carecer de poder politico, o destruir el existente, es hallarse o retornar a la condicion o estado de mera naturaleza, (donde cada hombre solo posee y cuenta con sus propias fuerzas mentales y pasionales para la autodefensa, de su propia vida, frente a los demas hombres, semejantes a el en fuerzas y peligrosidad, y con igual derecho natural a todo frente a todos, teniendo incluso derecho a la vida de los demas, en autodefensa de su propia vida) es asi mismo verse avocado a una vida de inseguridad y lucha, y en consecuencia a una vida solitaria, breve, brutal y corta. Como podra el hombre salir de de tan miserable condicion o estado de naturaleza, que es condicion de guerra.  la misma razon del hombre detectara y dictara como ley esencial de naturaleza, la necesidad de buscar la paz mediante un pacto simultaneo de todos y cada uno, de renuncia a su propio derecho natural a todo, en pro del hombre o asamblea que resultare elegido por mayoria como su representante. Al electo se le conferira la soberania por un simultaneo e inmediato pacto de sumision. Igual pacto de sumision legitimara al vencedor, a condicion de respetar la vida y libertad del vencido o vencidos, siendo la primera soberania por institucion y la segunda soberania por adquisicion.
