Forma parte de los mecanismos de estabilidad en la relacion de trabajo asalariado, y es una vicisitud proxima a la suspension del contrato de trabajo, pero, a diferencia de ella, no atribuye al trabajador el derecho a que se le reserve un puesto de trabajo en la empresa, en el que reincorporarse automaticamente a su termino. El efecto esencial de esta modalidad de excedencia es el derecho preferente al reingreso en vacantes de igual o similar categoria a la que desempe\u00f1aba el excedente con anterioridad.  esta sustancial distincion que puede establecerse entre ambas figuras conduce a afirmar que no tienen la misma naturaleza juridica. Por consiguiente, es preciso revisar algunos efectos que se han atribuido a la excedencia voluntaria partiendo de la tesis tradicional que la considera una causa mas de suspension del contrato de trabajo. Debe tambien destacarse la originalidad del ordenamiento laboral espa\u00f1ol frente a otros sistemas de derecho comparado en los que no existe una institucion como esta, que comparte caracteristicas
