Estructuracion de la relacion juridico-obligatoria de transporte de mercancias alrededor de la obligacion de transporte como fundamental, alrededor de la cual coexisten una serie de prestaciones instrumentales cuya finalidad es permitir la consecucion del transporte. El sistema de responsabilidad consagrado en la ltm y en el codigo de comercio continua basandose en el elemento culposo. La reforma en el sistema de responsabilidad se da, antes que en la modificacion de las reglas de responsabilidad, en la mutacion de las obligaciones que nacen del contrato (obligaciones de resultado a obligaciones de medio). La consagracion de los \u00abexcepted perils\u00bb en la ltm de 1949 no constituye mas que un mecanismo facilitado de la prueba, sin que por ello pueda descartarse la posibilidad de obtener el porteador su liberacion mediante la prueba del caso fortuito y la fuerza mayor.
