{"id":25359,"date":"2018-03-09T09:16:43","date_gmt":"2018-03-09T09:16:43","guid":{"rendered":"https:\/\/www.deberes.net\/tesis\/sin-categoria\/la-conciliacion-en-el-proceso-laboral\/"},"modified":"2018-03-09T09:16:43","modified_gmt":"2018-03-09T09:16:43","slug":"la-conciliacion-en-el-proceso-laboral","status":"publish","type":"post","link":"https:\/\/www.deberes.net\/tesis\/sin-categoria\/la-conciliacion-en-el-proceso-laboral\/","title":{"rendered":"La conciliaci\u00f3n en el proceso laboral"},"content":{"rendered":"<h2>Tesis doctoral de <strong> Juan  Carlos Garc\u00eda Qui\u00f1ones <\/strong><\/h2>\n<p>El estudio efectuado para la realizaci\u00f3n de la tesis doctoral que lleva por t\u00edtulo \u00abla conciliaci\u00f3n en el proceso laboral\u00bb parte de un concepto de conciliaci\u00f3n con un r\u00e9gimen jur\u00eddico que se reivindica, frente al proceso, como un paso adelante en el desarrollo del derecho, en la medida que aminora la distancia entre vencedores y vencidos, siempre y cuando se garanticen unos niveles de seguridad jur\u00eddica equivalente a aqu\u00e9llos que acompa\u00f1an al proceso judicial. A partir de esta constataci\u00f3n, en el cap\u00edtulo i se aborda la caracterizaci\u00f3n general de la conciliaci\u00f3n, analizando su concepto, sus clases, su naturaleza jur\u00eddica y su valoraci\u00f3n en el \u00e1mbito laboral tanto en lo que se refiere al ex\u00e1men de constitucionalidad como a la oportunidad de instaurar un doble tr\u00e1mite conciliatorio, previo y judicial.  a continuaci\u00f3n, en los cap\u00edtulos ii y iii, se desarrolla el estudio de la conciliaci\u00f3n previa.  en el cap\u00edtulo ii, se estudia su evoluci\u00f3n hist\u00f3rica, funci\u00f3n, obligatoriedad y efectos del incumplimiento de su intento y los supuestos excluidos de la misma.  por su parte, en el cap\u00edtulo iii, se aborda el ex\u00e1men pormenorizado del procedimiento de la conciliaci\u00f3n previa, desde el momento primero de la solicitud, aceptaci\u00f3n y registro de la papeleta de conciliaci\u00f3n, efectos de la presentaci\u00f3n de la solicitud, consecuencias de su omisi\u00f3n, celebraci\u00f3n del acto de conciliaci\u00f3n, para finalizar con el estudio de la impugnaci\u00f3n y la ejecuci\u00f3n de la avenencia consensuada en tr\u00e1mite de conciliaci\u00f3n previa, apartado este \u00faltimo donde se trata la incidenca de la conciliaci\u00f3n en la paralizaci\u00f3n\/eliminaci\u00f3n en el devengo de los salarios de tramitaci\u00f3n a resultas de la \u00faltima reforma legal actuada con la ley 45\/2002, concluyendo el cap\u00edtulo con el an\u00e1lisis de los efectos del acuerdo conciliatorio respecto a terceros, fondo de garant\u00eda salarial y
