Las muestras de expedientes corresponden a la ley org\u00e1nica 4\/1992, de 5 de junio y a la ley org\u00e1nica 5\/2000, de 12 de enero.  en los primeros cap\u00edtulos se repasan los modelos ideol\u00f3gicos de la delincuencia juvenil, la normativa legislativa espa\u00f1ola y los estudios emp\u00edricos realizados tanto nacionales como internacionales, para concluir exponiendo los objetivos e hip\u00f3tesis de investigaci\u00f3n, as\u00ed como la metodolog\u00eda elegida para el desarrollo del estudio emp\u00edrico.  en una primera secci\u00f3n se exponen los resultados descriptivos que definen cu\u00e1l es el perfir personal y sociofamiliar de los menores enjuiciados, adem\u00e1s de describir las circunstancias de todaslas fases procesales de ambos procedimientos.  tras la realizaci\u00f3n de un an\u00e1lisis de regresi\u00f3n log\u00edstica, queda probada la primera hip\u00f3tesis de investigaci\u00f3n: los menores con peores circunstancias sociofamiliares reciben medidas m\u00e1s restrictivas de derechos, pese a la comisi\u00f3n de infracciones de similar gravedad que los j\u00f3venes que no viven en tal situaci\u00f3n.  seguidamente se analizan los elementos que dan cuerpo a la naturaleza educativa de la ley, quedando confirmada parcialmente la segunda hip\u00f3tesis: las medidas desjudicializadoras y desinstitucionalizadoras se aplican t\u00edmidamente, as\u00ed como el amplio abanico de medidas sancionadoras que ofrece la ley, sin embargo el tiempo que necesita el proceso penal para sustanciarse es tan dilatado, que el car\u00e1cter aflictivo de la norma es el que adquiere myor relevancia.  por \u00faltimo, se realizan propuestas de mejora para este procedimento penal de menores.<\/p>\n<p>&nbsp;<\/p>\n<h3>Datos
