Xii, es la colecci\u00f3n jur\u00eddico-can\u00f3nica medieval m\u00e1s importante. En uno de los apartados de esta colecci\u00f3n, la distinci\u00f3n 37, se recogen y comentan los textos que la tradici\u00f3n jur\u00eddica hab\u00eda dedicado a la problem\u00e1tica presencia de los autores paganos en el mundo cultural del medievo. En este trabajo hemos analizado el estado de la investigaci\u00f3n sobre el texto y las fuentes del decretum gratiani, con la finalidad de aplicar los \u00faltimos avances a la distinci\u00f3n 37, tratando de reconstuir su proceso de formaci\u00f3n. Del an\u00e1lisis de esta evoluci\u00f3n se concluye que existe una modificaci\u00f3n sustancial del contenido ideol\u00f3gico original de esta apartado, que inicialmente era favorable a las letras gentiles y qued\u00f3 despu\u00e9s oscurecido por la interpolaciones.  los decretistas, comentaristas que trabajaron sobre el decreto graciano desde el momento de su redacci\u00f3n, dedicaron numerosas p\u00e1ginas a glosar y desarrollar los diversos pasajes de d.37. En esta tesis se editan por primera vez los textos de los decretistas hugo de ferrara y de juan de faenza y se exponen tem\u00e1ticamente los comentarios de los principales decretistas de la primera \u00e9poca sobre esta parte del decreto.  la literatura medieval y renacentista acudi\u00f3 al decreto de graciano especialmente para servirse de \u00e9l como fuente de autoridades. En el trabajo se analiza este uso, con especial atenci\u00f3n a dos \u00e1mbitos concretos: los \u00abespejos de pr\u00edncipes\u00bb de los siglos xii y xiii, y el debate humanista sobre el valor de la literatura gentil.
