Dolores <\/strong><\/h2>\n<p>Los cr\u00e9ditos refaccionarios son privilegiados, cualquiera que sea la naturaleza mueble o inmueble del objeto y, adem\u00e1s, si recaen sobre un inmueble, su titular puede afectar la finca objeto de refacci\u00f3n constituyendo una hipoteca que es legal, p\u00fablica y privilegiada. El fundamento de las farant\u00edas dispuestas en su favor como afirma la mayor\u00eda de la doctrina, no radica en evitar un enriquecimiento sin causa, pero s\u00ed un enriquecimiento injusto. La utilidad de la calificaci\u00f3n refaccionaria del cr\u00e9dito depende de la posici\u00f3n que se adopte frente a la anotaci\u00f3n preventiva, pues la garant\u00eda dispuesta en el art\u00edculo 42-8. Lh mejora a la hipoteca convencional en que puede constituirse sin recabar el consentimiento del deudor, pues la simple anotaci\u00f3n del cr\u00e9dito refaccionario obrante en documento privado es constitutiva de hipoteca legal. Su inter\u00e9s radica en que no todos los acreedores que han financiado la adquisici\u00f3n, construcci\u00f3n o conservaci\u00f3n de una cosa por su deudor est\u00e1n hoy en situaci\u00f3n de reforzar convenientemente su derecho ya sea porque su posici\u00f3n en la relaci\u00f3n jur\u00eddica es de debilidad frente al deudor, ya porque la garant\u00eda hipotecaria es cara. Tal es la situaci\u00f3n de los modestos constructores, del vendedor a plazos, del permutante de solar por obra futua y del comprador de un piso sobre plano o en construcci\u00f3n que paga parte del precio antes de que se le transmita la propiedad del mismo. En este \u00faltimo caso la anotaci\u00f3n del documento privado de compraventa al amparo del art\u00edculo 42-8.
