En derecho tortsino hay dos clases de costumbres:  escritas y no escritas (lo que se manifiesta a partir de 1241 en la sentencia de flix i se corrobora con las confirmaciones reales desde 1399). 2. Encontramos costumbres escritas que prueba la evolucion a traves de diversas redacciones en la misma carta de poblacion (1149) hasta la redaccion final (1277): a) las referidas a la jurisdiccion b) la costumbre de coltell tret c) la costumbre referida a troba de moros. 3. De ello deducimos que las costumbres forman un codigo escrito mucho antes de lo que se suponia (entre 1240 y 1245) y que el codigo de las costumbres de tortosa no depende de los fueros de Valencia: entre otras cosas porque tortosa incorpora la costumbre de mar ya en el codigo redactado en 1272 (mientras que Valencia no lo hara hasta 1283). Porque las costumbres de tortosa se divide en 9 libros desde 1772 (mientras que los de Valencia lo hacen en dos libros  y hasta casi dos siglos mas tarde no se adopta la division en 9 libros).
