(mobbing)"},"content":{"rendered":"<h2>Tesis doctoral de <strong> Ram\u00f3n Gimeno Lahoz <\/strong><\/h2>\n<p>El trabajo de investigaci\u00f3n surge en el a\u00f1o 2001,  ante la necesidad de hacer  frente a una nueva realidad jur\u00eddica,  el mobbing. Para ello fue decisivo el estudio de lo publicado (b\u00e1sicamente de ramas ajenas al derecho) pero sobre todo las entrevistas con las v\u00edctimas de mobbing y sus asociaciones; este extremo, unido a la ausencia de un tratamiento internacional, oblig\u00f3 a un camino autodidacta para definir mobbing jur\u00eddicamente.  la tesis define mobbing como la presi\u00f3n laboral tendente a la autoeliminaci\u00f3n de un trabajador mediante su denigraci\u00f3n (presi\u00f3n laboral tendenciosa), y con ello por primera vez se tiene una definici\u00f3n de mobbing en l\u00ednea y media, con plena validez jur\u00eddica, que es susceptible de ser memorizada y por lo tanto divulgada, para corregir el problema. El denominado \u00abconcepto uniformado de mobbing\u00bb recalca la denigraci\u00f3n como mecanismo frente a los tratos degradantes y recalca la autoeliminaci\u00f3n como finalidad de un comportamiento doloso.  el trabajo aporta f\u00f3rmulas para deslindar casos de mobbing de otras figuras pr\u00f3ximas, y en este sentido debe citarse \u00abla regla del 9\u00bb  para saber si hay mobbing; en sede de estad\u00edsticas se critican metodol\u00f3gicamente muchas de ellas presentadas hasta el momento y se aporta alguna en sede de tribunales; pero sobre todo se advierte de los riesgos jur\u00eddicos de una previsible regulaci\u00f3n espec\u00edfica antimobbing, mediante el examen de las distintas definiciones que se han esgrimido hasta el momento.  la segunda parte de la tesis profundiza sobre el grado de sensibilizaci\u00f3n de nuestro ordenamiento jur\u00eddico y tribunales, a cuyo fin se ha trabajado con m\u00e1s de un centernar y medio de sentencias dictadas sobre la materia, y por supuesto la totalidad de las recogidas en las bases de datos de las editoriales.
