Debido a estos factores, la regulaci\u00f3n espa\u00f1ola del derecho a la propia imagen se centra de modo casi exclusivo en sus aspectos morales, olvidando los patrimoniales. Este concepto hace que surjan conflictos cuando se llevan a cabo negocios relativos al uso de la imagen de terceros. No es sencillo unir los intereses de propiedad de una persona en controlar el uso comercial de su identidad con esta proteccion, principalmente basada en un concepto de derecho de la personalidad intransmisible.  el right of publicity estadounidense se desarrolla como un derecho de propiedad sobre los aspectos comerciales de la identidad, a partir de la privacy. esta protege frente al da\u00f1o moral causado por la apropiaci\u00f3n de la identidad personal. El right of publicity se conforma como un derecho de propiedad sobre los aspectos comerciales de la identidad, por lo que es completamente transmisible y permite su uso como si se tratara de cualquier otro tipo de propiedad.  en este estudio se analiza el right of publicity americano y a continuacion, se estudia el derecho a la propia imagen en espa\u00f1a, de forma paralela. una vez analizados ambos, la separaci\u00f3n absoluta de los aspectos personales y patrimoniales no parece posible, pero resulta clara la necesidad de desarrollar en derecho espa\u00f1ol, la regulaci\u00f3n de los
