Esta directiva va a ser punto de referancia obligado en el an\u00e1lisis de la rectiva va a ser punto de referancia obligado en el an\u00e1lisis de la normativa espa\u00f1ola de seguridad social, junto al art\u00edculo 14 de la constituci\u00f3n para las materias expresamente excluidas del \u00e1mbito material de \u00e1quella.  de todo ello se desprende que ciertos preceptos de nuestra seguridad social constituyen discriminaciones directas e indirectas por raz\u00f3n de sexo; otros, sin ser tales s\u00ed producen efectos adversos para las mujeres, que de por s\u00ed parten de una situaci\u00f3n laboral previa desfavorable en comparaci\u00f3n con la del var\u00f3n.  en todo este estudio juega un papel destacado el tema de las justificaciones de las discriminaciones indirectas denunciadas que pueden articularse para destruir la presunci\u00f3n discriminatoria. Se deja abierta una puerta a las autidades nacionales en orden a justificar los preceptos discriminatorios y as\u00ed eliminar esa presunci\u00f3n.<\/p>\n<p>&nbsp;<\/p>\n<h3>Datos acad\u00e9micos de
