{"id":84161,"date":"2000-10-04T00:00:00","date_gmt":"2000-10-04T00:00:00","guid":{"rendered":"https:\/\/www.deberes.net\/tesis\/sin-categoria\/el-despido-libre-y-sus-limites-en-el-derecho-norteamericano\/"},"modified":"2000-10-04T00:00:00","modified_gmt":"2000-10-04T00:00:00","slug":"el-despido-libre-y-sus-limites-en-el-derecho-norteamericano","status":"publish","type":"post","link":"https:\/\/www.deberes.net\/tesis\/ciencias-juridicas-y-derecho\/el-despido-libre-y-sus-limites-en-el-derecho-norteamericano\/","title":{"rendered":"El despido libre y sus limites en el derecho norteamericano"},"content":{"rendered":"<h2>Tesis doctoral de <strong> Yolanda Cano Galan <\/strong><\/h2>\n<p>No es correcta la crrencia generalizada de que el sistema de regulaci\u00f3n del despido en estados unidos es un sistema de \u00abdespido libre\u00bb, ya que la teor\u00eda del \u00abemplyment at-will\u00bb en sentido puro -sin excepciones- que supondr\u00eda que tanto el empresario como el trabajador pueden terminar la realci\u00f3n laboral a su voluntad, es decir, por buena causa, por mala causa o incluso sine sgrimir causa alguna, es de aplicaci\u00f3n a un n\u00famero muy reducido de trabajadores.  para conseguir cierta estabilidad en el empleo y evitar situaciones que violen derechos y libertades fundamentales de los trabajadores, los tribunales norteamericanos han limitado la aplicaci\u00f3n a ultranza de la teor\u00eda del \u00abemployment at-will\u00bb a trav\u00e9s de la adopci\u00f3n de excepciones.  en estos momentos la regla es de aplicaci\u00f3n s\u00f3lo para aquellos trabajadores con una relaci\u00f3nlaboral por tiempo indefinido no regulada por convenio colectivo, y no en su sentido puro. Un empresario ya no podr\u00e1 despedir a los trabajadores por cualquier raz\u00f3n, por lo que la teor\u00eda del \u00abemployment at-will\u00bb, ha pasao a ser la doctrina de derecho com\u00fan por la cual los empresrios y los trabajadores no cubiertos por convenio colectivo pueden terminar la relaci\u00f3n laboral por buena causa, y en aquellos supuestos no protegidos estatutaria o jurisprudencialmente incluso sin causa, pero ya no por \u00abmala causa\u00bb.  los trabajadores conuna relaci\u00f3n laboral regulada por convenio colectivo -que en derecho norteamericano se denomina trabajadores sindicados-, no est\u00e1n sometidos a la teor\u00eda del \u00abemploymente at-will\u00bb y por lo tanto el empresario no podr\u00e1 despedirlos excepto en cumplimiento de las previsiones
