Debido al aumento de los \u00edndices de divorcio, los investigadores de la d\u00e9cada pasada han cambiado su perspectiva y se han concentrado en la investigaci\u00f3n del divorcio como una experiencia personal que est\u00e1 enormemente influida por la situaci\u00f3n social y el marco econ\u00f3mico. El objetivo de esta tesis es investigar el divorcio como un fen\u00f3meno de masas como se manifiesta en la mayor\u00eda de los pa\u00edses europeos y, en particular, en espa\u00f1a. Partimos de la base de que para entender las razones por las que se genera un divorcio y sus consecuencias, tenemos que ver la disoluci\u00f3n matrimonial como un fen\u00f3meno que resulta de la intersecci\u00f3n entre el aspecto personal, los factores socioecon\u00f3micos y el marco legal. La separaci\u00f3n y el divorcio afectan a todos los miembros de la familia y, sobre todo, a los ni\u00f1os. El estudio presenta un an\u00e1lisis detallado del divorcio como un proceso psicol\u00f3gico que est\u00e1 ubicado en un marco social y en un contexto legal. Por esta raz\u00f3n, se persiguen tres l\u00edneas de investigaci\u00f3n: primero, se presenta una visi\u00f3n de conjunto del proceso de disoluci\u00f3n matrimonial como un fen\u00f3meno psicosocial, econ\u00f3mico y legal; segundo, esto genera una revisi\u00f3n de la bibliograf\u00eda actual sobre el divorcio y sus consecuencias tanto para los padres como los hijos; y, tercero, intentamos explicar el divorcio mediante la propuesta de un nuevo marco conceptual y el desarrollo de nuevos modelos explicativos. El cap\u00edtulo primero desea resolver la cuesti\u00f3n de por qu\u00e9 tantos matrimonios acaban en divorcio. Presentamos una descripci\u00f3n detallada de los factores que contribuyen a la desestabilizaci\u00f3n de la instituci\u00f3n matrimonial. El cap\u00edtulo segundo presenta las causas que influyen en los esposos para presentar un procedimiento de divorcio. El cap\u00edtulo presenta diferentes modelos conceptuales mediante los cuales pueden ser comprendidos dichos factores. Estos elementos incluyen factores personales, familiares y culturales. El cap\u00edtulo tercero analiza las consecuencias de la disoluci\u00f3n matrimonial en los ni\u00f1os y adolescentes. Se investigan las consecuencias que genera en los descendientes el proceso de ajuste que se lleva a cabo en el divorcio. El cap\u00edtulo presenta un modelo te\u00f3rico que permita mediar y moderar los factores que influyen en dicho ajuste. Se pone especial inter\u00e9s en investigar el efecto que tiene sobre el bienestar infantil las regulaciones de custodia. En el cap\u00edtulo cuarto se realiza un estudio pormenorizado de 135 recursos de apelaci\u00f3n ante la audiencia provincial durante el a\u00f1o 2007 repartidos de modo al\u00edcuota por toda espa\u00f1a. Se eval\u00faan los resultados dos a\u00f1os despu\u00e9s de la reforma de derecho de familia espa\u00f1ol del 2005. El foco de inter\u00e9s de dicho estudio recae sobre la custodia compartida. Introducimos un marco conceptual que contiene cinco grupos de factores decisivos que predicen las disposiciones de custodia. La investigaci\u00f3n intenta aclarar si existe una vinculaci\u00f3n directa entre los factores mencionados en el modelo y la probabilidad de que se llegue a una decisi\u00f3n a favor de una custodia compartida. Se pone especial atenci\u00f3n en indagar la argumentaci\u00f3n legal que se desarrolla al respecto con el fin de llegar a un acuerdo sobre la custodia. El cap\u00edtulo quinto investiga el papel de la mediaci\u00f3n familiar en el proceso de divorcio. El apartado presenta una descripci\u00f3n de las t\u00e9cnicas de mediaci\u00f3n y describe detalladamente los mecanismos que se desarrollan durante el proceso de mediaci\u00f3n. El objetivo de la tesis ha sido proporcionar un marco te\u00f3rico exhaustivo con el fin de entender el fen\u00f3meno tan complejo como es el divorcio.  palabras clave: derecho de familia, derecho civil, divorcio, custodia compartida, mediaci\u00f3n familiar.  abstract  divorce has long been viewed as a single phenomenon affecting two individuals without considering the framework conditions in which it occurs. Due to the increase of divorce rates in the past decades researchers have changed their perspective and have concentrated on the view of divorce as a personal experience that is greatly affected by the socials and economic environment. The aim of this thesis is to investigate divorce that has become a mass phenomenon in most european countries and particularly in spain. The assumption is that in order to understand the grounds for divorce and its consequences, we have to view divorce as a phenomenon that occurs at the intersection of personal, socio-economic and legal factors. Separation and divorce affect all the members of the family, especially children. The study presents a comprehensive analysis of divorce as a psychological process that is situated within a social and a legal context. It follows three lines of investigation: first, it presents a comprehensive view of divorce as a psychosocial, economic and legal phenomenon; second, it contains a review of the research literature about divorce and its consequences for parents and children; and third, it intends to explain divorce by proposing conceptual frames and explanatory models. Chapter 1 addresses the question of why so many marriages end in divorce. We give a detailed description of how these factors contribute to the destabilisation of the institution of marriage. Chapter 2 presents the factors that influence the former spouses in their process of adjustment to divorce. The chapter presents several conceptual models from which these factors can be understood. These include personal, relational and cultural factors. Chapter 3 deals with children and adolescents and their process of adjustment to divorce. The chapter presents a theoretical model of mediating and moderating factors that have some bearing on adjustment. Special reference is made to different custody regulations and their effect on child well-being. Chapter 4 presents an analysis of 135 spanish divorce sentences which were brought before spanish courts of appeal in the year 2007, two years after reform of spanish family law in 2005. The focus of interest lies on the issue of joint custody and how often parents opt for this arrangement. We introduce a conceptual frame that contains five groups of decisive factors that predict custody arrangements. We want to know whether there is any relation between the factors mentioned in the model and the probability of a joint custody decision. Special attention is given to the legal argumentation for a custody arrangement in the court sentences. Chapter 5 investigates the role of family mediation in the divorce process. The chapter presents an overview of mediation techniques and gives a detailed description of the mechanisms that come into effect during the mediation process.
